So, why are American jobs given to foreigners when America now has an overabundance of experienced professionals?
First, Alan Greenspan states in his book "Age of Turbulence" that as the economic advisor to every President from Nixon to George W. Bush, he has always advised and believed that all immigration laws should be waived to allow foreign workers free access to U.S. based jobs to force the American middle class to compete with foreign wage scales. The intended effect is to drive down wages for all Americans. Of course, we would be driving to Mexico or another third world wage level.
Second, Elaine Chao, wife of Congressman Mitch McConnell, and President Bush's appointment as Secretary of Labor from 2001 to 2008, stated the government's policy in her Strategic Report 2006-2011, which is that "a qualified U.S. worker can be displaced from a job in favor of the foreign worker." At page 35, she wrote that:
H-1B nondependent employers are not subject to the conditions [of searching for qualified U.S. workers], and their H-1B workers may be hired even when a qualified U.S. worker wants the job, and a U.S. worker can be displaced from the job in favor of the foreign worker. (Emphasis added.)
Ms. Chao's opinion flies in the face of Congressional intent to protect Americans but more dismaying was the failure of Senator McConnell to correct his wife or to protect American workers. Even President Bush accepted and left uncorrected this brutal opinion of his Secretary of Labor. Thus, both Congress and the President accepted the Government's actions of alllowing harm to Americans. Ms. Chao then made this astonishing statement: "Additionally, the importation of the foreign worker will not adversely affect the wages and working conditions of U.S. workers." Please note that this statement was made after Ms. Chao spent 35 pages explaining all the governmental activity (and billions in taxpayer's money) that are required to provide job retraining for displaced American workers.
Third, Secretary of State Hillary Clinton in 2010 authorized the investment of between $10 and $36 million to train several thousand Sri Lankans in advance computer software principals in order to compete with U.S. workers for U.S. jobs. Similarly, the U.S. government invested an undisclosed sum in Armenia to train workers to compete with U.S. workers.
Fourth, in 2007, Secretary of Defense, Robert Gates was quoted by the NY Times as saying that there should be "no limit" on importing foreign labor. He was referring to jobs held by middle class workers with a college education. Finally, President Obama has frequently stated that he favors preferences given to foreign workers. It was the intent of his administration to allow admission into the U.S of over 6,500,000 foreign workers to take U.S jobs.
The Government's betrayal of our economic democracy has been occurring for years and can be found in reams of books and eyewitness testimony. To day, the practical effect of the Government's betrayal is seen and felt by millions of Americans all across this country. The current case of Beasley v. Molina Healthcare, Inc., filed in Long Beach, California by leading civil rights attorney James Otto proves beyond doubt the Government's betrayal. In that case, 220 highly trained American workers were replaced by Molina Healthcare, Inc. and Cognizant Technology with foreign workers, simply because the Government and corporations have joined to put Americans out of work. The 21 plaintiffs not only lost their jobs, as a result, they lost their homes, marriages, and their careers. Molina humiliated Americans by maliciously forcing them to train their replacements before they were fired from their jobs.
The complaint alleges the company falsely swore to the Department of Labor that it was not replacing any U.S. worker by bringing in over 500 foreign workers. According to the lawsuit, the Director of Human Resources' investigation established testimony from 160 IT employees testifying to the rampart segregation of U.S. workers; the Budget Manager has testified that Molina had plenty of work but decided to fire all U.S. workers; and two Directors of the IT Department have stated that Molina did intend to segregate all American workers out of their labor market.
Perhaps equally egregious, the lawsuit alleges that "the entirety of Molina's annual income comes from the U.S. taxpayer via the federal government, which pays the MEDICARE and MEDICAID claims filed by Molina's insured. In other words, public monies fund Molina that has collected over $9 billion dollars from the U.S government just in the last three (3) years and spent a large portion of the taxpayer's money to fire American workers and to hire an abundance of workers brought in from India." According to the law suit "By way of Molina's operations, several billion of U.S. taxpayer dollars have gone directly to India without any benefit to the American economy or to the U.S. taxpayer.”
Otto's legal complaint further alleges that "After the mass layoff of all U.S. workers, the IT Department exceeded its annual budget by over $5.5 million dollars only three (3) month into the year, due to the increase in the number of laborers from India. Yet, Molina's management continued to insist on hiring the more expensive Cognizant H1-B contractors over the less expensive U.S. workers, who were more experienced and knew Molina's business systems."
Yes, American firms have failed to adhere to civil rights laws, but, it is the U.S. Government that is providing them with the surreptitious strategies to illegally discriminate against the entire American workforce. The betrayal of the American dream of "fairness to all" is dwarfed by the wrongful use of tax money to educate foreigners AND provide them with a preference to take American jobs. Such job preferences allowed by the Government has resulted in the segregation of U.S. workers out of the job market.
Some 60 years ago, Rosa Parks was told to ride in the back of the bus; today, Americans are told they are not welcome aboard their own bus. Is that the “CHANGE” we want?
Government has a role in today's world. For example, Government should maintain a military and/or police force to protect Americans. However, the Government is misusing the military/police if it arrested innocent and harmless Americans who merely wanted to protest in a public square.
The proper role for Government is immigration controls to protect American jobs in order to bring the American dream to all Americans. From 1890 until today, the immigration laws have had one sole purpose - to protect Americans and American jobs. Beginning in 1990, our Government betrayed the American dream by granting immigration preference to Wall Street corporations that allows them to import foreign labor to replace all U.S. workers. Thus, tax dollars are used to hurt American citizens.
If you are still not convinced that the U.S. Government does not fully comprehend the enormity of the problem, then look at the statistics published by the Department of Homeland Security. These prove that the U.S. continues to admit foreign labor into the country at higher rates than the pre-2008 recession levels. Between 2001 and 2006, the average number of admitted foreign "workers and trainees" into the U.S. was only 860,000. However, these numbers increased drastically beginning in 2007:

The above numbers are quoted from the Department of Homeland Security 2010 Yearbook of Immigration Annual Statistics, table 25, page 64, and shows the number of admitted foreign persons allowed into the U.S. as "workers and trainees." That means every admitted foreign worker or trainee was admitted on an employment visa, which required every foreign worker had to be employed by a U.S employer before entering the U.S.; thus, every foreign worker was taking jobs that either would have been available to or were already occupied by U.S. workers. In the category of "Worker and Families" that were admitted into the U.S., the numbers increase by an average of 74% per year. Because many of these families include a working spouse, the impact on US. workers and lost U.S. jobs could be as much as doubled.
As a statistical note, during the years 2001 - 2006, an economic boom time, the average number of admitted foreign workers or trainees into the U.S. was only 860,000. Then, between 2008 and 2010, an economic recession, the average number of imported foreign workers or trainees into the U.S. was 2,157,000. That means during a major recession, the U.S. government allowed a 150% increase in the importation of foreign labor.
In 2010 alone, with an unemployment rate of over 9% (over 13,000,000 unemployed) and in the midst of a major recession, the U.S. increased its importation of foreign workers by 65% over 2009 (up to 2.8 million) that had a 325% increase over the 2001-2006 average of 860,000.
Americans feel the disconnect between "no jobs available" and importing millions of foreign workers. Is it purely coincidental that from 2008 through 2010, 8.4 million foreign workers found U.S. based jobs, while, according to the U.S Bureau of Labor Statistic, during the same time period, the U.S. lost approximately 8.4 million jobs.
How can a company make record profits if it cannot afford to employ workers? Even during the current recession/depression, corporate profits skyrocketed, and, coincidentally, politicians collected millions of dollars from corporate campaign gifts.
Finally, to see why the "disconnect" is real view this 2007 YouTube video (http://programmersguild.blogspot.com/2007/06/youtube-gate-cohen-grigsby-train-how-to.html) that shows a national immigration law firm conducting a training seminar to a corporate audience. Listen well. They actually state "the goal is NOT to find a qualified American worker." The attorneys are teaching corporations the strategies to avoid hiring American workers-while they, in fact, hire cheaper foreign workers. This five minute video will anger every patriotic American.
We now have an oversupply of unemployed college educated professionals along with new graduates whom we have paid so dearly to educate. Beyond any reasonable doubt, the American Government is allowing the intentional excluding of American talent in order to seek foreign labor. Each year over 2,000,000 U.S. jobs, on average, that require a college degree and specialized training are being taken away from educated, middle class Americans workers and students by unqualified workers imported from other countries. These jobs are not being transported overseas. Rather, the labor is being imported here and it's all due to work preference for foreign workers that have been set up by the U.S. government. Facilitated by Congress, a company uses their competent American worker to train H-1B foreigners, then fires the American worker and reduces the pay to the H-1B foreigner. Congress has always known of this practice to replace U.S. workers and in response passed laws to make it easier to do so.
There are "foreigners only" want advertisement all across the country. Outside of Chicago an advertisement for a SAS programmer boldly states, "H-1b Holders Only". Another advertisement is for an Entry Level job for foreign students - ONLY. A third advertises "Walk-in Interviews" for a job opening in New Jersey - but you must go to Pune, India to interview! Indian headhunters are recruiting abroad for K-12 teachers, cancer surgeons and real estate salespersons to work in the United States. Exelon, an information technology staffing firm based in Rolling Meadows, Ill., posted an advertisement for a technical writer to work on projects for a Chinese client. The advertisment read "arrogant American(s)" need not apply.
In fact, American corporations, such as Amazon, McAfee, and Synapse Design, regularly hold job fairs in the Untied States but only foreigners are invited.
American college student are faced with employers who will only hire foreigners. The U.S. Government has established preferences for foreign students to get into a U.S based school and the gives them preferences to jobs while in college, through the OPT and/or CPT visas. Over 2,000 jobs for entry level college graduates can be found on the internet at any one time. Yet, more than half of those job opportunities are for foreigners ONLY.
The result is an inequality that is rapidly undermining democracy. Like an odorless gas, every corner of our country is being sapped of its strength. The evidence of the economic pollution is everywhere. As Bob Dole once said" The poor don't contribute to campaign funds." Our government is consistently favoring the rich. This is the sad source of the problem.
If history has proved anything, it's that the Government's kowtowing to Wall Street and Corporate America does not work. The result for everyday Americans' lives has been under whelming, and that's a price we can't afford to keep paying.
