If you’re not aware, much to the dislike of 4409 on Sept 28th
2008 a settlement had been reached for the suit filed by 4409 against the City
of Scottsdale for slew of things like unlawful arrest, assault and battery.
The Administration still refuses to apologize for any
wrongdoing even though their very own employees admit to the wrongdoings.
Furthermore, an Internal Affairs investigation also found them liable for
“excessive force” (which is just a nice way of saying assault and battery)
Since this settlement was for an amount over $20,000 it had
to be forwarded to the Scottsdale City Council for approval. When looking over
the resolution agenda I noticed a blatant misrepresentation of the record of
what transpired on August 27th 2008 that led to the lawsuit Shelton
In the background information on the consent agenda item# 5:
1. The City claims I refused to identify myself. This is
simply not true referenced by the Rule 20 acquittal of the charge of “refusal
to identify” and I would like that false information removed from the City
2. The City also claims that during the booking process
Shelton “physically” resisted efforts to obtain fingerprints. This also is
simply not true referenced by the Rule 20 acquittal of the charge “obstruction
of governmental operations” AND the internal affairs depositions where the defendant
admitted I was NOT physically resisting anyone. Furthermore, numerous other
detention officers Waskowsky, Lee, and Garland, also gave similar statements.
What did happen that night of August 27th 2008?
I was unlawfully arrested by Officer English who knew what
he was doing was illegal but did it anyway. Harassed, antagonized, treated like
dirt, thrown into a freezing cold cell with no bed and no water on multiple
occasions then due to my political beliefs Detention Officer Hale decided to
take his steel-toed boot and stomp multiple times on my bare foot causing a
crush injury. Other detention officers made statements on the record that Officer Hale was overheard repeatedly
yelling, “I bet you’re a Constitutionalist” and other political dogma.
Lets get one thing straight, no one I know hates government. They just
dislike corruption and the system that allow that corruption to continue.
To get the settlement funds the City Council is now robbing the Loss
Trust Fund Reserve, which I believe is for the city healthcare and funneling that
money to The Risk Management operating budget. (710-03740-52483). Risk
Management will then foot the bill and the City is going to raise property
taxes on the citizens of Scottsdale in order to make Risk management whole
again. Seems to me the city should return the money back to the Loss Trust Fund
Reserve but it seems as though they are just reimbursing Risk Management for
their costs during this lawsuit.
Why should the citizens have their property taxes raised for
the unlawful actions of the police? Why don’t the city cut the police budget or
elsewhere to retain this money instead of raising taxes on the citizens for their failures?
