U.S. Senate candidate shot in the back by Metro officer David Michael Gilbert files federal lawsuit. Officer brandishes gun at process server.

On October 29th, 2009, Jim Duensing was shot by David Michael Gilbert an officer of the Las Vegas Metropolitan Police force at a traffic stop near Cheyenne and Michael in Las Vegas Nevada. With his hands raised above his head backed up against his rental car, Duensing was shot at point blank distance in the heart with a Taser brand electric rifle. He ran from this excessive and abusive force and while running down the sidewalk with empty hands, he was shot three times from behind at a dead run.

The complaint names, David Michael Gilbert, the Las Vegas Metropolitan Police Department, and Taser International as defendants. It alleges, among other things, excessive use of force, obstruction of justice, and perjury.

The case number is: 2:11-cv-01747-GMN-VCF

David Michael Gilbert was served a copy of the above complaint this weekend on October 29th, 2011 around 2:30 p.m. - about the same time as the original incident 2 years before. Gilbert answered the door with a gun in his hand and brandished it in a way that made sure the process server saw it. Gilbert refused to accept the paperwork. A copy of the complaint was left outside his front door at 948 San Gabriel in Henderson Nevada. Gilbert wouldn't be worried if he had nothing to hide.
