Here is legislation that I am proposing to my State representative to be enacted in Arizona. I Would welcome feedback, and information on having it introduced in the State of Arizona legislature. The laws of the state of Arizona shall be amended as follows: No person in the State of Arizona shall be confined to a medical quarantine in any place without first being proven to be a contagious risk to others. No medical quarantine shall last beyond the period in which the quarantined person is contagious. No general quarantine of non-contagious persons shall be authorized. Nor shall any business or not for profit organization be ordered to close or cease operations without its employees or staff first being proven to be a contagious risk to others and subject to quarantine. In all cases of quarantine, the State shall issue a Declaration of Quarantine describing the individual to be quarantined, the place of quarantine, and the specific disease or condition that the person quarantined is allegedly a carrier of. This Declaration of Quarantine must be accompanied by a certified copy of the medical test used to prove a person is a carrier of the condition described in the Declaration of Quarantine. The person being quarantined has the right to challenge the validity of a Declaration of Quarantine and its supporting tests, and may provide, at his own expense, contradictory test results. A judge shall determine the validity of tests in cases of dispute. In all cases of quarantine, the State shall issue a moratorium on any and all, mortgage payments, time payments, leases, and bills for the quarantined person for the duration of the quarantine. Neither the State of Arizona nor any political subdivision thereof, nor any corporation or individual shall be allowed to repossess or seize any property or money of a quarantined person for the duration of the quarantine and for one calendar month post quarantine. All quarantined persons shall maintain all rights of freedom of speech and communication during a stay in quarantine. Neither the State nor any quarantining authority shall deny the right of a quarantined person to communicate with others outside of quarantine. The State shall not deny a quarantined person his or her parental rights, and all minor children or children under guardianship shall remain in the custody of a quarantined person. No minor child in the custody of a quarantined person shall be placed in foster care or other temporary care without the written consent of the quarantined person or his legal representative. No medication shall be given the child of a person in quarantine without the knowledge and consent of the quarantined parent / legal guardian. All reasonable effort shall be exercised to secure the care of any and all livestock or pets owned by a quarantined person. The right of habeas corpus shall not be denied a quarantined person. Any person or entity who violates the rights of a quarantined person shall be guilty of a felony and subject to a term in prison of not less than a year, and a fine of not less than $100,000 USD.
