Jose Guerena, a 26-year-old Marine and Iraq war veteran, was killed May 5 when a SWAT team broke into his home a little after 9:30 a.m. According
to Guerena's wife, Vanessa (who was home at he time, along with their
4-year-old son), Guerena thought the police were home invaders. He
ushered his family into a closet, then grabbed a rifle. When the police
battered down the door, they saw Guerena and his rifle, and opened fire.
The SWAT team released 70 rounds. Guerena didn't fire a shot; the
safety of his rifle was still on.

Could be an expensive waste of time and resources …
I really hope that the suit filed will prosper – meaning that the Court will not just brush it aside, and into the trashcan goes this very expensive and futile exercise.
During the SWAT raid, the ex-Marine involved in drug-trafficking and related criminal activities was prepared for the raid, and was holding an assault rifle ready to shoot-it-out when he was gunned down. Under that situation or circumstances, which will be exposed in Court, his death does not make any law enforcement officer liable. Let’s not forget that the dead ex-Marine was not an angel that in law was killed by demon-hunters – the law enforcement officers.
While the case is expected to be dismissed or thrown out of Court, the only outcome that can be expected is that the filing of the suit will encourage Government and State haters, specifically those who disparage and/or have an ax to grind against, persons of authority and persons in authority, to shoot-it-out with police or law enforcers whenever there is an arrest or police raids in progress, and like Guerena who didn’t even have an iota of a Chinaman’s chance to survive at all, just end up dead.
Anything else said and done with regards to the filing of this particular case in Court is irrelevant politicking. To say that this drug-trafficker suspect was "murdered" in cold blood is just talking to himself or to herself.
The image of the nation's Marine Corp was terribly soiled by one of their kind that chose the path of law-breakers that as Marines they are sworn to fight. Help from the Marine Corp in this case is highly unthinkable, and expecting material and legal aids are unlikely forthcoming.
Good for them!
I'd like to see the governor, state police, and State Attorney General included in the suit!?
I suspect that the family could raise some funds by appealing to former and current Marines - maybe even a stray citizen, on a web site.
If the family is fortunate, they will have a Marine for an attorney. Or, at the very least, they will engage one of the few barristers who value truth and honor.
