John Stuart found guilty.

09-04-2013  •  http://kpho.membercenter.worldnow.com/story/233302
Police documents show Beasley then got out of his car and went up to Stuart. Stuart claims he shot Beasley in self-defense. The case against Stuart encountered lengthy delays. Multiple defense attorneys were appointed and later withdrew. Stuart, who acted as his own attorney, filed numerous pre-trial motions. The first trial lasted 29 days before a mistrial was declared. The jury in the second trial deliberated for eight hours over three days before finding Stuart guilty on both counts. He faces up to 43 years in prison when he's sentenced on Oct. 24.

From his daughter Patty:

Please say a prayer for John Stuart....

Hi Everyone,

This is Patty, John's daughter. John was convicted today. I am sorry I didn't get this email out earlier, but I am just trying to get my head together. I called a few people today from my dad's phone today, but there are so many I didn't get around to them all. I will be making more phone calls tomorrow.

My father's attorney asked that I get letters from as many people as possible about how my father has positively impacted your life. All of these can be emailed back to this email and I will get them all together. He wants to use them at John's sentencing. Which will be October 24 at 1:30 pm so if I could these letters by September 30th that would be greatly appreciated. My father's private investigator also asked that people call him because we are trying to figure who we are going to have speak at his sentencing. His name is Lee and his number is (602) 410-3417.

My dad is currently at 4th Ave jail and his booking number is T008067. I will be gonig down there on Thursday to visit him and putting money on books. If at any time any of you have some extra cash to donate that would be very much appreciated. I will be putting all donations on his books.

If anyone needs to get ahold of me or just has questions or anything you are more than welcome to give me a call. I will also be checking my father's emails everyday. Thank you so much for all of your support.

Patty

Very sad outcome.  Are there any useful objections preserved to form a viable appeal?  IIRC, the small snippets that came from his defense attorney early on suggested gigantic procedural wrong-doing on the part of the MCOA, the Clerk, and the Superior Court, itself.  A real miscarriage.

It is amazing how badly the AP has erred in the story.  But it did get one quote:

"Although this defendant attempted to justify his actions by claiming self-defense, this jury was able to clearly able to apply the important distinction Arizona law makes between the legitimate and illegitimate use of deadly force," remarked Maricopa County Attorney Bill Montgomery.  "While nothing will ever fully assuage the grief felt by the victim's family and friends for the loss of their loved one, today's result at least provides a measure of justice for a senseless act of violence," he added.

I am saddened to see that in Arizona a man can get out of his car in anger, be an extreme DUI (0.19) and place his arms inside a seat belted driver's car on the driver side and a shot rings out and it is the seat belted driver who is charged with both 2nd Degree murder AND laughably "drive by shooting."

I am dismayed a 12 person jury would convict on either charge.
