4409 -- VICTIM recalls a horrific bloody fight with Pastor Anderson...ohhh the humanity!

I personally could care less about the fraudulent claims Mr. Cairns is trying to sneak into the Yuma Municipal Court....thats what appeals are for.. but others wanted me to post this.

Yuma City Prosecutor Jay Cairns is now attempting to charge people, including myself and Pastor Anderson with crimes he "KNOWS" [emphasis added] never happened.
 Call and explain to Mr Cairns that a malicious prosecution under the color of law will not be tolerated and sanctions will be sought. His actions are damaging to the credibility of many honorable prosecutors in the State of Arizona.

The Pastor and others were charged with 13-2904 A1 Disorderly conduct
 A. A person commits disorderly conduct if, with intent to disturb the peace or quiet of a neighborhood, family or person, or with knowledge of doing so, such person:

1. Engages in fighting, violent or seriously disruptive behavior.

Arizona case law:
Arizona  supreme court has construed the phrase “seriously disruptive behavior” as being “of the same general nature as fighting or violence or conduct liable to provoke that response in others and thus to threaten the continuation of some event, function, or activity.” In re Julio L., 197 Ariz. 1, 4, ¶ 11, 3 P.3d 383, 386 (2000).
GOD HELPS US ALL.....ITS WAS LIKE THE L.A. RIOTS ALL OVER AGAIN...the violence, the carnage, the talking back and forth...OMG

Isn’t it ironic how the prosecution waited until the whole world heard of Pastor Anderson’s ‘Fire and Brimstone’ sermons to initiate a warrant for his arrest, based upon SENSATIONALISM and ‘blood in the water’ like sharks-reactivity to a freedom-free feeding-frenzy??!!


The pastor NEVER made contact with the two BP’s, although they were seen smiling and nodding towards him / us inside the private seating area; before the famous 30 seconds of video took place. The ONLY THING Anderson is ‘guilty of’ is DEFENDING HIMSELF FROM THE ATTACKS OF this so-called ‘witness’...although 'Perpetrator' is a much better fit from where the TRUE VICTIMS sit, (in our private dining area away from all the Yuma city employees, BP’s and BS at that nasty pizza place).




She literally "SCOLDED HIM" (one eyewitness account from police statements states plainly) in front of us in the private room and actually said to him directly; in front of ALL of us “You should have OBEYED the Border Patrol agents and you wouldn’t have gotten tased”.  No, she's not BIASED in ANYWAY...LOL, (but we still deserved getting hooked up by Johnny Law, right Jet?)




She nor ANYONE there ever did ask any of us to leave the (*ahem) 'restaurant', and the police obviously didn't care for our 'TASERS ARE FOR PUSSIES' sign, posted in the back winder o' Liberty One-(they made reference to it in the report, but only the 'tasers' part, even though two witness statements spelled it out for them...guess officer K. Celaya #5480 didn't want to make it too obvious that she was on a 'mission to make an example' of us).




It is time for us to RALLY TOGETHER, not separate or divide. What side of the table will YOU be seated at, gentle reader??

Actually 4409, the "victim" is not the complainant.  In fact the owner or manager is the one who filed charges.  Why the city attorney chose to expand them to now include Pastor Anderson is a serious question, considering the evidence of a crime being committed by the two originally charged is dubious.  The timing to coincide with the County Prosecutor failing to get his way in court the same day strikes me as the most likely motive.

Section 242 of Title 18 makes it a crime for a person acting under color of any law to willfully deprive a person of a right or privilege protected by the Constitution or laws of the United States.


For the purpose of Section 242, acts under "color of law" include acts not only done by federal, state, or local officials within the their lawful authority, but also acts done beyond the bounds of that official's lawful authority, if the acts are done while the official is purporting to or pretending to act in the performance of his/her official duties. Persons acting under color of law within the meaning of this statute include police officers, prisons guards and other law enforcement officials, as well as judges, care providers in public health facilities, and others who are acting as public officials. It is not necessary that the crime be motivated by animus toward the race, color, religion, sex, handicap, familial status or national origin of the victim.


The offense is punishable by a range of imprisonment up to a life term, or the death penalty, depending upon the circumstances of the crime, and the resulting injury, if any.

This cannot be the only police statement.  Where is the rest?  I will grant you, the manager's has to be the most damning, and if this is it Yuma city government will be in a federal civil rights unlawful detention suit for years to come, but, they have to have more.  You have to have more.  So post it and let people decide for themselves if the city prosecutor met his ethical standard of reasonable suspicion to go forward with prosecuting any of the three on the charge of disorderly conduct (fighting, A1).
