Surgical Clinics, Ltd., the largest and oldest group private surgical practice in Arizona. He is also a Senior Fellow at the Cato Institute in Washington, DC.  He was integrally involved in the creation and passage of the Arizona Health Care Freedom Act and serves as treasurer of the US Health Freedom Coalition, which promotes state constitutional protections of freedom of choice in health care decisions. He was a regular contributor to Arizona Medicine, the journal of the Arizona Medical Association from 1994-2016.

He also serves as a member of the Advisory Board Council, as well as an adjunct instructor, at the Center for Political Thought and Leadership at Arizona State University. He writes and speaks extensively on regional and national public policy, with a specific focus on the areas of health care policy and the harmful effects of drug prohibition. He received his B.A. from Brooklyn College (CUNY) and his M.D. from New York Medical College. He is a Fellow of the American College of Surgeons.

ST. PAUL, Minn.—Third-party control. Surveillance. Data collection. Privacy invasions.

These are not words that should be associated with a visit to the doctor, but the presence of electronic health records (EHRs) intruding on the patient-doctor relationship makes these phrases commonplace in health care.

A new, groundbreaking book from Citizens' Council for Health Freedom (CCHF) will expose  how the mandated, government-certified EHR technology (CEHRT) has negatively affected both doctors and patients.

The chapter titles alone let readers in on how EHRs have impacted their health care without their knowledge. "Big Brother in the Exam Room" explores how the EHR mandate became law; methods Congress used to seize control of the exam room; "meaningful use" mandates; prescription tracking; clinical chaos; burned-out physicians and frustrated nurses; how EHRs interfere in patient care; security breaches and safety incidents; how HIPAA doesn't protect privacy; black-box treatment algorithms; the timeline of federal legislation that led to third-party-payer controls; and much more.

Health care's "Big Brother" makes itself known in the exam room through the national medical-records system, national patient ID initiatives, big data profiteering, consent and coercion, government intrusion, research at the bedside, Affordable Care Act experiments, the population health agenda, and tracking Americans in sickness and health.

As Open Enrollment Approaches, CCHF Says a Flawed Government Plan Raises Premiums, Compromises Care and Puts Patient Privacy at Risk

ST. PAUL, Minn.—As Americans wait for Texas federal Judge Reed O'Connor to rule on the latest Obamacare case brought by 20 state attorneys general, the American public faces another open enrollment under the Affordable Care Act (ACA).

Open enrollment begins Nov. 1 and continues through Dec. 15 for coverage to start as soon as Jan. 1, 2019. Since the signing of the ACA by former President Barack Obama back in 2010, Citizens' Council for Health Freedom (CCHF) has been committed to encouraging Americans to "Refuse to Enroll." There are better ways, says CCHF president and co-founder Twila Brase.

"Now, as many Americans may be looking at their options for care and coverage in 2019, they should know that the downfalls and risks of enrolling in Obamacare outweigh the benefits," said Brase. "Besides the high costs of coverage and the narrow networks and limits on access to care, patients' private data is shared, stored and used by other government agencies—without consent. Private personal and financial information is entered into, shared and stored by the federal data services hub of Healthcare.gov. Furthermore, signing up on this federal exchange gives enrollees government coverage. All Obamacare enrollees are applying to the federal government. Brase said there are wise—and legal—alternatives to signing up for costly government coverage:

"Importantly, the mandate to be covered is still in place, so nabbing an exemption is wise," said Brase. "While Congress zeroed out the costly penalty tax for 2019, Congress did not repeal the ACA mandate to be insured. It only zeroed out the penalty. The language for the mandate and the penalty are still in law, but the cost of the penalty is now zero dollars. While this provides temporary relief to many, another Congress could turn around and reinstate the penalty for being uninsured in the future because the penalty language is still in the ACA. And they could make the penalty even higher than before."

Americans should also know that the individual penalty was zeroed out beginning in 2019, so those who went without coverage in 2017 and 2018 may be still on the hook for penalties—and may still be able to claim exemptions to avoid the penalties.

Citizens' Council for Health Freedom: Does Your Candidate Support Freedom or Socialized Medicine?

Pre-Existing Condition Mandate is the Cornerstone of Socialized Medicine

ST. PAUL, Minn.—The majority of voters will have health care on their minds when they vote next Tuesday.

According to a Kaiser Family Foundation Election Tracking Poll, 71 percent of voters say health care is a "very important" issue for the midterm elections. In fact, about a third (30 percent) say it is the "most important" issue.

With health care a crucial election matter, Citizens' Council for Health Freedom (CCHF) wants to make sure Americans are informed about what a candidate's support for a mandate to cover uninsurable pre-existing condition means for the future of health care costs, access and quality. 

"Americans must not cast their vote based on the pre-existing condition issue," said CCHF president and co-founder Twila Brase. "The entire premise of socialized medicine is government-mandated coverage for pre-existing conditions. Unfortunately, Americans who support pre-existing condition coverage often don't know they are supporting socialized medicine and, with it, higher costs, decreased access to services, delays, denials and reduced quality of care. True insurance indemnifies against the risk of getting a condition. Therefore, candidates who support government-mandated coverage for uninsurable pre-existing conditions support socialism and government control of doctors and hospitals. We should solve the uninsurable, pre-existing condition problem, not use it to socialize medicine."

Brase noted that most states—35 in all—had affordable, popular plans for people with uninsurable conditions until Obamacare outlawed them. The Obamacare mandate to cover uninsurable conditions eliminated real insurance and made premiums unaffordable and unattractive.

"Unfortunately, Republicans do not seem to know how to argue against the pre-existing condition mandate," she said. "They may be too focused on coverage and not focused enough on care. It's easy to say yes to covering everything and politically difficult to explain why government-mandated coverage for uninsurable conditions is a bad idea for patients, medical excellence and health freedom. I've yet to hear them tell Americans that the pre-existing condition mandate is the cornerstone of socialized medicine and the cornerstone of Obamacare. I've yet to hear them argue that, as in Canada and England, many of the covered will find it difficult to access the chronic and catastrophic care they need under a socialized medicine scheme."

True insurance no longer exists because of the pre-existing uninsurable condition mandate, Brase added. In its place is the health plan, a corporate version of socialized medicine set up to centralize data, decisions and dollars, with the authority to ration care.  

"The real answer is to uninsurable pre-existing conditions is to move away from the cause of them," Brase continued. "Pre-existing conditions emerge primarily from aging out of family coverage or losing employer-sponsored coverage. We should move away from employer-sponsored coverage and family coverage and return to individual insurance, preferably for a lifetime and purchased before birth by parents for the child.  Tax equity would be a great place to start. Give everyone the same tax break employers get so the market for individual policies grows. Then repeal the ACA's prohibition on catastrophic indemnity policies. And then encourage indemnity companies to sell parents individual policies for their pre-born child—policies that can last a lifetime. And then encourage and expand charity options for care for those who truly need it."
