Obama Supports DNA Sampling Upon Arrest

The nation’s chief executive extols the virtues of mandatory DNA testing of Americans upon arrest, even absent charges or a conviction. Obama said, “It’s the right thing to do” to “tighten the grip around folks” who commit crime.

When it comes to civil liberties, the Obama administration has come under fire for often mirroring his predecessor’s practices surrounding state secrets, the Patriot Act and domestic spying. There’s also Gitmo, Jay Bybee and John Yoo.

In California in 2009, in a rape case, a state district attorney to circumvent the Statute of Limitations that was about to expire for prosecution—filed a warrant based on the perpetrator’s DNA to issue an arrest warrant.

Police to circumvent the requirement to show probable cause, covertly collect abandoned DNA belonging to suspects. Police follow suspects to retrieve their abandoned cigarette butts coffee cups, straws, tissues and utensils to mention a few that are then subjected to DNA analysis by police. Police will provide someone a soft drink in order to get their DNA. or collect DNA off water bottles left in interrogation rooms. After police collect “Abandoned DNA” they can monitor a suspects movements. Consequently innocent persons have been shocked to learn their DNA is in a government DNA database. The Supreme Court ruled there is no subjective expectation of privacy in discarded genetic material or expectation of privacy. However police may not be able to legally retrieve someone’s cigarette butt or other genetic material from their yard. Police have detained people, not arrested them and taken DNA. With out a conviction being necessary before government can take a suspects DNA, lends itself to corruption that police will cause false arrests to get DNA. In some states, repeated discovery of crime lab scandals cross- contaminating DNA or mixing up other people samples have lead to dismissing charges and cases against suspects and convicted persons. One of the scary things about DNA evidence, it is so easy for corrupt police to plant DNA to frame someone.
