Texas Army Sergeant who Killed BLM Protester for Wielding Rifle at His Car Sentenced to 25 Years

Perry claimed self defense but was convicted by a jury, and he was sentenced to 25 years in prison by a judge that has been described as radical. Both Perry made provocative statements about the BLM-Antifa protests and Foster made provocative statements about people who opposed the protest riots. Texas Governor Greg Abbott has said he intends to pardon Perry, who he insists acted in self-defense. The state constitution limits Abbott to a pardon only on the recommendation by the state Board of Pardons and Paroles. The board can recommend a pardon to the governor on a majority vote from its seven members.

A photo shows Foster holding his rifle, but it is disputed whether he is pointing it at Perry's car or at the ground.

The victim, Garrett Foster, 28, had pointed a gun at Perry's car, leading him to fire back at the protestor
