UPDATED: Russell Pearce caught Red-Handed Lying (now for a second time)

UPDATE Posted 3/18/10 4pm

Russell Pearce caught lying again.  Russell Pearce is now sending out this information in addition to the email below.

"It is not true and it is not there at all.

*Legislative Alert for 3/16/10 - Update *

HB2632 did not pass COW (Committee of the Whole) today in the house! It
appears that an open boarders person named Ernest Hancock
<http://www.ernesthancock.com/> mass emailed the House Legislators
claiming that HB2632 is a backdoor to the Real ID ACT
<http://en.wikipedia.org/wiki/REAL_ID_Act>. This is a blatant lie and
voting has been postponed to a date to be determined most likely next
week but maybe as soon as tomorrow 3/18/10. The fact of the matter is
that the Real ID ACT was nullified
<http://www.tenthamendmentcenter.com/2009/04/29/nullification-revisited/>
by Arizona which joined more that 20 states in 2007.  This whole email
campaign was just short of a domestic terrorist act."

There are so many things wrong with the email above.

1) Russell Pearce is playing games, alternating between the real concern "national id" and trying to tag the concern to the (currently dormant) "REAL ID" which is also a national id.  Well, we know Pearce's bill doesn't "require" REAL ID.  However the data exchange and immigration check occurs against the REAL ID database.  If you READ HIS BILL (section 2, 11-1051, F.), a law abiding Arizona citizen cannot obtain a drivers license  without the state first exchanging their data with the US Department of Homeland Security.

2) Calling a law abiding American, Ernest Hancock (love him or hate him) a domestic terrorist for expressing his 1st amendment right to petition the government is an outrage.
His real offense is confronting and opposing Russell Pearce, the Great.

3) Even now Russell Pearce has STILL NOT ADDRESSED the problems in his bill!  He has protested that he's against national id.  That national id "is not in there", though he hasn't demonstrated that.  Now, he's resorted to calling names.

It's like kindergarten.  Russell Pearce, FIX YOUR BILL!
Remove section 11-1051 Section F and I, the implementation of national id in Arizona.

Dear Russell Pearce,

Your record does speak for itself.  You are the ONLY PERSON IN ARIZONA TODAY who is pushing national id for law abiding Arizonans/American citizens.

STOP IT.

Until you stop it, we will undertake efforts to stop you and expose you.

Yet again your 4 page email treatise below goes on and on and on, but it does not address the problems in the bill, specifically that your bill requires law abiding Arizona citizens to have to exchange their data with the US Department of Homeland Security and get prior clearance from same before getting a state drivers license.

THAT IS NATIONAL ID.

Despite your continued protestations to the contrary that you are against national id, YOU CONTINUE TO PUSH NATIONAL ID.

Why?  Stop it.

Either you'll stop it, or we will stop you from doing it and expose you either as being igorant or lying.

Which is it?

Are you ignorant about the contents of your own bill?

OR ARE YOU LYING ABOUT IT?

The words of the bill speak for itself.  The national id is right there in there in 11-1051 Section F. 1-3.

As of yet, you have yet to refute this, address it or fix it.

Subject: HB2632/SB1070 a good bill a must pass to stop the billions in cost, to save American jobs, to stop the killings and maimings of our citizens, etc.
To:

My Dear friends and family, I would hope my record of vigilance in defense of freedom and our Constitutional liberties would cause folks to think twice before believing I would do a back door attempt to promote any type of National ID.

Ernie Hancock put out information on this bill that needs to corrected right now about a National ID piece and an ability to detain folks indefinitely.  I wrote the bill and it has NO such provision.  It is such a stretch, it is unbelievable. I have a memo from our Constitutional attorney coming to verify this very fact.  It is the black helicopter mentality. I understand and believe in the Constitution and work hard to honor it in all I do.  I do not now or never have supported any form of National ID.  The other issue he speaks about is detention.  Nothing in this bill allows for detention of citizens at all and illegal aliens only as allowed under federal law for purposes of determining legal status for purposes of deportation.

I was co-sponsor on the legislation to stop the Real ID from being imposed on Arizona, I also sponsored 10th Amendment legislation recognizing Arizona as a Sovereign Republic as guaranteed in Article 4 Section IV of the U.S. Constitution and the 9th and 10th Amendments of the Constitution. I am consistently rated as the #1 or in the top by the Goldwater Institute as the top defender of the Liberty. Constitution and Limited Government ally of the public.

www.russellpearce.com  I have worked hard to make sure our laws are enforced and we end this illegal invasion that is destroying America.   We are in very tough times with Gangster Government in D.C., and with folks here at home that ignore their responsibility to protect you life, your liberty and your property, not take them away from you.

"Let the American youth never forget, that they possess a noble inheritance, bought by the toils, and sufferings, and blood of their ancestors; and capacity, if wisely improved, and faithfully guarded, of transmitting to their latest posterity all the substantial blessings of life, the peaceful enjoyment of liberty, property, religion, and independence." --Joseph Story, Commentaries on the Constitution, 1833

When a government breaches its limitations placed upon it by a constitution, (a) the government agent loses its trust to rule, (b) the powers delegated to it are reverted back to the creators of the constitution, and (c) the constitution becomes non-binding on those who created it. This is the natural law concept of “the consent of the government,” as expressed in our Declaration of Independence.

Particular to the United States, the U.S. Constitution was voluntarily formed as a compact by existing sovereign states with existing state constitutions. Despite the deceptive proposition that the States were created by Congress, the States existed prior to and independent of any Congress, as confirmed by the Treaty of Paris in 1783 (which, by the way, was not overturned by any subsequent legal action of the states). “The State governments, by their original constitutions, are invested with complete sovereignty.” Alexander Hamilton, FP 31. And, “Each State, in ratifying the constitution, is considered as a sovereign body, independent of all others, and only to be bound by its own voluntary act.” James Madison, FP 39.

"The whole of that Bill [of Rights] is a declaration of the right of the people at large or considered as individuals... [I]t establishes some rights of the individual as unalienable and which consequently, no majority has a right to deprive them of." --Albert Gallatin, letter to Alexander Addison, 1789

Thank you for your support today.  Enough is enough. Don't be fooled by the miss information given today in committee by those who oppose any and all enforcement.  I will not attend another funeral without having done all I can to enforce our laws.  We must enforce our laws with compassion, but without apology.

I have been to court (federal court) 7 times on Prop. 200 and 5 times on Employer Sanctions and we have won all 12 times.  The language will survive the challenges by the open border/ACLU/MALDEF/AND OTHERS, as the left and cheap labor crowd continue to tell it has drafting errors.  Not true.  The old attorney trick.   I refuse to attend another funeral of a Police Officer or of a Citizen without doing everything I can do to enforce our laws.  Government is complicit in the deaths, maimings and cost to our citizens.

Remember the Police Chiefs had a Press Conference several months ago right after Officer Erfle was murdered by an illegal alien and stated they refused to enforce our immigration laws.  No surprise they have concerns (invented to protect the status quo).  They do not want to enforce the laws and have stated, that is why they have so many roadblocks in place and as testified to investigations on officers who called ICE.  In fact they are investigating one commander for arresting homicide suspects that were illegal aliens, because he did not get permission from higher command officers.  Look at the endorsements, Sheriffs, Police Officers, many, many others and just Saturday by a unanimous vote of over 1400 Maricopa County PC's endorsed this effort.  80% of the public support this effort.

I just had a meeting with law enforcement this noon and they were extremely upset that their were concerns about their ability to "know" when and when not to arrest with the silly arguments or concerns presented by some.  That is what they do for a living.  They don't go around arresting people based on appearance!!!!!  They have been restrained from doing the very job they took an Oath to do.  Protect and to Serve.   Enforce all laws.  They have been to many funerals, many which could have been prevented.

We are a nation of laws. We must have the courage – the fortitude – to enforce, with compassion but without apology, those laws that protect the integrity of our borders and the rights of our lawful citizens.

"Support Our Law Enforcement and Safe Neighborhood Act".  Senate Bill 1070  passed the Senate on party lines, I believe it will pass the House and I have a commitment from the Governor to sign it.  It will be the toughest Enforcement bill in the nation.
God bless them all and keep them safe.

"SUPPORT OUR LAW ENFORCEMENT AND SAFE NEIGHBORHOOD ACT"

1. Illegal Sanctuary Policies: Eliminate ALL sanctuary cities in this state and allow legal our law enforcement offices to enforce our laws and protect our neighborhoods.  Allow our citizens the right to sue "their" government for failure to follow the law, only if they have policies in direct violation of the law.

2. Trespass: Makes entering or remaining in Arizona in violation of federal law a state crime and "allows" law enforcement to arrest them on trespass violation or just call ICE to take them and deport them. (law enforcement's choice).  This allows them to hold those that are being investigated for serious crimes and not have deported before the investigation is completed or turn them directly over to ICE to avoid local jail costs when possible.

3. Day Laborer Enforcement:  Makes it illegal for an illegal alien to solicit work (day laborers) and makes a misdemeanor for anyone with a license to do business in Arizona to pick up any day laborer without filling out a employment application.  Makes it a state crime to aid, harbor, conceal transport or attempt to aid, harbor, conceal or transport an illegal alien for purposes of work with a mandatory impoundment of their vehicle under 28-3511 for 30 days.  Also adds a mandatory $1000 fine per illegal alien being transported.

Closing our borders is a must; however it must be coupled with interior enforcement.  Attrition by enforcement.  Strict enforcement.  It is time to renew our efforts to end ALL sanctuary policies in our states and our nation: Require officials to fully enforce federal immigration laws of the United States. NO MORE TAXPAYER BENEFITS OF ANY KIND, No Amnesty, No retreat, No surrender.  We will take back America one state at a time.   It starts here!!!!!

•         8 USC Sec. 1325:   (ILLEGAL ENTRY)
•         8 USC Sec. 1324:   (Hiring an ILLEGAL)
•         8 USC Sec. 1644:   ("No local ordinance, rule, or measure shall stop law enforcement officers from enforcement of this section")
"Any person who knowingly hires/harbors/transports any illegal alien is guilty of a felony punishable by:
•         10 years in prison
•         $2000 fine per illegal alien
•         Forfeiture of the vehicle or property used to commit the crime."

"All officers whose duty it is to enforce criminal laws shall have authority to make arrests for a violation of any provision of this section" (affirmed US v Perez-Gonzalez 2002 Fed App 0360, 6th Circ.).

"We Don't Need No 'Stinkin' 287g;” Local Law Enforcements Has Inherent Authority to Enforce Immigration Law; the only restriction is the political handcuffs placed on our law enforcement officers by politicians.

Today we will take the "political handcuffs off from our law enforcement officers;"  the only reasons our immigration laws are not enforced are Political, not a lack of Authority.

This Citizens Initiative will pass by 70% to 80% by the voters.  The last four (4) Propositions I placed on the ballot in '06 passed by an average of 75%.

It was just endorsed again by MCRC and this last Saturday by over 1400 PC's at our Maricopa County Republican meeting.  Also a unanimous endorsement of a Resolution by the State Republican Party and the Maricopa County Republican Party at their annual organizational meetings with over 800 PC's present last year at each meeting in order to support our citizens Constitutional right to have our laws enforced and recognizing the damage to our state/nation in cost in crime, jobs, dollars to Arizona citizens and taxpayers;
We demand the end to all "Catch and Release" policies in the state of Arizona and further we will be filing a Citizens Initiative to remove/end all sanctuary policies in the state of Arizona.  No more Catch & Release.  We the legal and lawful citizens demand the enforcement of our laws.

I believe we have the votes in both House and Senate and the Governor's support.  We must not take anything for granted and be vigilant in the effort to protect this Republic and make our neighborhoods safe.  We will need everyone's help.  We need to contact every single legislator and encourage them to support this legislation. You can use www.LifeLibertyFreedom.com to contact all the Legislators at once.

The political handcuff's place on our Home Town Heroes must be removed.  The burden of blind-eye police department policies and open-border philosophies were paid for with the lives of not only our police officers throughout our state, but the danger clearly spread beyond law enforcement into our communities with more lives being lost the citizens we have sworn to protect.  The quality of life in our state is being sacrificed for political correctness. Government is complicit in the deaths, maimings, jobs taken from Americans, billions in cost to educate, medicate and incarcerate those illegally in this nation and state.  Enough is enough.
I am former Chief Deputy of Maricopa County Sheriff’s Office with 23 years of service. Two of my son’s are law enforcement officers: My son Sean Pearce a Deputy Sheriff, was shot in the line of duty, by an illegal alien while serving a homicide warrant on Dec. 16, 2004. He was shot in the chest and stomach.  He was critically wounded, but has since recovered and has been released back to work full time. What made this so unusual was I was at the Brookings Institute talking about our nation’s failed immigration policies in Washington D.C. actually at the podium when I was handed a note from my wife, stating, "There is an emergency at home, call immediately."  I stepped off the stage, found a phone and called home to find that our son had been critically shot and was being Air-Evacuated to a hospital.

I was the author of Proposition 200, Arizona Citizens and Taxpayers Protection Act; known as Protect Arizona NOW that overwhelmingly passed at the polls ‘04 by the voters to 1) requires proof of citizenship to register to vote; 2) requires ID at the polls when one votes; 3) requires proof of eligibility and legal presence in the U.S. to get public benefits
