Purchase the land using a $20 gold piece in part. Pay the land off, so there is no mortgage. Include in a re-filed deed after the mortgage has been paid off that the filing of the deed is for ownership evidence only. If the land was ever homesteaded in any way, bring the land patent up to date. The land is now no longer real estate, but private property.
