California Supreme Court Rules Texts Can Be Searched Without Warrant

On Monday, the California Supreme Court ruled that police do not need a warrant to search a cell phone carried by someone who is under arrest. The state court ruled 5-2 that police can search items found on defendants when arrested. In 2007, U.S. District Court Judge Susan Illston ruled that police could not search the cell phones of defendants without a warrant. In 2009, the Ohio supreme court ruled against the illegal search of cell phones as well.
