A quick review of Arizona Revised Statutes indicates that Trooper E.J. McNeill may have been making it up as he went along.

ARS 28-733 appears to be the only pertinent statute & it states ADOT may prohibit pedestrians but signs to that effect must be erected. Additionally, any such restriction must apply equally to all.

If an exception has been made for Border Patrol agents operating federal checkpoints then that same exception applies to individuals exercising their First Amendment Right to assembly, speech and redress regarding those same checkpoints.

What say any attorney's reading this?
