Victory For Law Firm In Second Amendment Case

The incident occurred on June 17, 2014, during a dispute occurring on the I-17 freeway. The brandishing of the gun case was in response to a threat posed by another motorist. This is a victory for gun rights advocates as the state had argued that simply brandishing an unmarked gun case containing a firearm is criminal conduct. However, the defense argument invoking defensive display of a firearm pursuant to A.R.S. § 13-421 ultimately prevailed in convincing the court to grant a motion for judgment of acquittal pursuant to Criminal Rule 20.
