Genya Markon, 78, leased her home in the Hamptons Bays to Julie Rinke in July 2020

Rinke, a real estate agent, was due to move out by June 18, 2021, but failed to do so

Markon has now filed a lawsuit in Suffolk Supreme Court to force Rinke out

Markon claims that Rinke is taking advantage of pandemic eviction bans

Rinke should not be protected by the ban, Markon said, as it was a short lease

Markon also accuses Rinke of damaging furniture and leaving trash to fester
