2.  Did you get the audio recording of the hearing?  I would love to hear you plead the 5th, and be threatened with and held in contempt.  Or were you giving testimony that opened you up to cross-examination?

I commend you for taking a stand against this "Police State & Prison Planet."

Currently, I'm tasked with the responsibility of completing a manuscript by April 2010, so I'm unable to travel to your location at this present time.

I will stay abreast of your situation because I may have to dance with those devils myself due to the angelic contents of the book being penned.

Since I have little confidence that the rest of America will wake up in time,  I've embarked upon a mission to sound the alarm!

Alright, after looking up your case, what a crock!  You absolutely are not guilty of at least four of the charges brought against you under AZ law.  That is under a 50cc engine so it is not a motorcycle under the law.  That damned excuse for a judge knows that full well!  You are not required to have a drivers license, proof of insurance or vehicle registration because it is not a vehicle -- it is a bicycle -- in the eyes of the law.  

A fourth charge --no helmet/eye protection was dismissed by the judge.  Do you want to know why?  Because there is not law requiring such in AZ for anyone over 18 years which Nick surely is.  And truthfully the bicycle helmet law may end well before the 18th birthday.

So, the final charge is "improper position for left turn" which I presume means riding on a side walk.  Depending upon the circumstances this is the only thing I can see you having to fight and losing in the long run.

Clearly the cop and the judge just don't like your attitude.  The cop threw everything he could think of at you.  And the judge is there to support him.

Should I request a new trial, or just appeal after this one is over on the 19th? 

After they scam you and find you guilty IMMEDIETELY file a motion for a new trial.

Then when they deny that file and appeal but remember you have to have reversible errors on appeal.

I think that you are taking the correct course of action and I commend your refusal to cower in the face of oppresive tactics.  I have long been of the opinion that the public at large when faced with any charges in a court of law, should fight those charges to the maximum extent that the law allows if they indeed feel they are not guilty of the accusations.

Most Americans are under the unfortunate assumption that they can not "fight city hall".  This is a sad fact in this country and the idea that law enforcement agencies and the courts are somehow superior to the public they supposedly serve is the deplorable result of brainwashing in the public schools and in the media.  Few people understand that they do not have to just roll over and accept charges that are levied against them. 

It is not only our God given right to fight against unfair, unjust or untrue accusations - it is a DUTY to call into question our accusers!  It is our DUTY to question agencies motives and to hold them completely responsible for enforcing the law without prejudice!  It is our DUTY to investigate and understand the law and to call to the publics attention, instances where the law is being skirted, ignored or misrepresented.

I wish you the best of luck tomorrow and I sincerely hope that you continue to update us on your case.  I would love to see the transcript of your case appearances as I am sure a lot of people would.  Perhaps you could make those available for everyone to read so we may see injustice at work.

Do not shrink in the face of injustice.  Do not allow the court to violate your Constitutional rights.  Do not cave-in to threats or oppression.  You have our support!

I would expect that you will be found in contempt and jailed at least over the weekend.  I am always suspicious when a judge schedules anything for Friday afternoon, because it is so hard to respond to their actions before the weekend ends.

Yea Nick Id be there for you, Wearing my Title 4 Flag of the uSA Attending as a Witness but I'm doing the same thing in Washington State commonly refered to as the STATE of WA,  A Corporate Foreign State, A State below a State. Which is un Constitutional and a FRAUD on the People I apply this Paperwork to ALL Corporate Foreign State Courts Called a " Notice in Law " and then File Fraud charges against All those responsible involved and they run away  as fast as they can. The Corporate Official Political Policy Enforcement Regulatory Servents          ( COPPERS ) Dont Seem To Like Me Much but its the Judge I'm after, after all  he's just an attorney wearing a dress. The more you impeach them for failing their Oath to uphold the Constitution the less likely they are to Receive pay raises or recognition for higher positions like COUNTY  Judges and it doesn't matter if they are high or low criminal charges against Judges still stick like glue to their records...

Well, I went to Nick's hearing.  Bottom line, a continuance because the judge was "ill." Rescheduled for April!  One of the cops was there too --- being paid of course.

Either he was sick, or he does not want to go through with his threat to find Nick guilty of criminal contempt if he fails to sincerely genuflect to the cops he claims he has introduced the evidence to prove they are lying.  Nick made it clear he would not so apologize.

Fortunately, California has made it clear in the DMV code book.

Section 406b defines an electric bike is not a motorized bicycle, nor a motor cycle. Arizona's DMV codes should have an equal definition pursuant to the doctrine of equal footing. I wouldn't mind getting a copy of your Senate Bill.

So what did the court end up doing with this B.S. e-bike thing?

Nick Bravo AKA Ryan Fenster has since lost all credibility. After this electric bicycle incident, he relocated to Los Angeles and became involved in a real estate scheme of submitting forged document with the county clerk's office to illegally obtain properties that were the unclaimed inheritances of poor people and minorities. As of April 2014, Nick Bravo is wanted by the police and in hiding, living in a motor home in a secluded area.
