"They" have assigned this bill to who they consider to be the pro-Ron Paul more libertarian conservative, Rep. Andy Biggs of Mesa.
They have tasked Andy Biggs to do the "dance", i.e. to come up with plausible deniability so they can still pass national id but say they didn't pass national id.
IT IS VITALLY IMPORTANT THAT *YOU* CONTINUE TO CALL AND EMAIL YOUR STATE REPS AND SENATORS
Tell them that you oppose SB1070 and HR2632 as written.
Tell them that if they do not remove ALL OF Section 2, Title 11-1051 or at least Section 2, Title 11-1051 F. 1-3 and I. that it is unacceptable and must be opposed.

Arizona will have national id AS OF TODAY, MARCH 17, 2010 unless your legislators hear from YOU by phone and email IMMEDIATELY.

SB 1070, sponsored by Sen. Russell Pearce, R-Mesa, won Senate approval and was awaiting action by the House. HB 2632, sponsored by Rep. David Gowan, R-Sierra Vista, was awaiting a vote by the full House.
This is one you can't ignore, because it will not ignore you. This bill enables any government employee at any time for any reason to access or require you to divulge personal information not otherwise required by law and exchange it with Homeland Security. Further, you can be denied a drivers license for not doing so. You can be detained without recourse if a law enforcement officer cannot identify you via a Homeland Security database check.
This bill also completely indemnifies law enforcement officers and agencies from ANY action taken under this law.

F. Except as provided in federal law, officials or agencies of this state and counties, cities, towns and other political subdivisions of this state may not be prohibited or in any way be restricted from sending, receiving or maintaining information relating to the immigration status of any individual or exchanging that information with any other federal, state or local governmental entity for the following official purposes:
1. Determining eligibility for any public benefit, service or license provided by any federal, state, local or other political subdivision of this state.
2. Verifying any claim of residence or domicile if determination of residence or domicile is required under the laws of this state or a judicial order issued pursuant to a civil or criminal proceeding in this state.
3. Confirming the identity of any person who is detained.
I. A law enforcement officer is indemnified by the law enforcement officer's agency against reasonable costs and expenses, including attorney fees, incurred by the officer in connection with any action, suit or proceeding brought pursuant to this section to which the officer may be a party by reason of the officer being or having been a member of the law enforcement agency, except in relation to matters in which the officer is adjudged to have acted in bad faith.
