TOPIC FOR SHOW:

Court: FBI Must Destroy Memos Calling Antiwar.com a Threat

Ruling comes after a eight-year battle over secret surveillance of the popular website after 9/11.

By Kelley Beaucar VlahosSeptember 12, 2019

In a major victory for Antiwar.com, free speech and journalism, a federal appeals court has ruled that the FBI must expunge surveillance memos that agents had drafted about the website's co-founders Eric Garris and Justin Raimondo in the early years following the 9/11 attacks.

"It's been a long fight and I'm glad we had an outcome that could might affect future FBI behavior," said Garris, who runs Antiwar.com, based in the San Francisco Bay area. "I just wish Justin was still here to know that this has happened."

Raimondo, 67, passed away in June from a long bout with cancer. He and Garris had sued the FBI in 2013 demanding it turn over all the memos and records it was keeping on the two men and the website, which has been promoting anti-interventionist news and views from a libertarian-conservative perspective since 1995. (Full disclosure, this writer was a regular columnist for Antiwar.com beginning in 2009).

They won their case, and in 2017 the FBI agreed to turn over all the memos and settle their legal fees, $299,000, but the final expungement of two key memos involving intelligence gathered on the men and Antiwar.com, had yet to be expunged from the agency's record.

As this writer pointed out after the 2013 lawsuit was launched, the years following the 9/11 attacks were particularly heady for the FBI. Thanks to the Patriot Act, the federal law enforcement agency got sweeping new powers to spy on Americans, and they used those authorities with gusto, and harassing activists and journalists—even mainstream organizations like The Associated Press—became de rigueur.

It all began when an observant reader brought a heavily redacted 2004 memo to Antiwar.com's attention in 2011. It was part of a batch of documents the reader had obtained through FOIA requests. It was clear from the documents' contents that the FBI had been collecting information and records on Raimondo and Garris for some time. At one point the FBI agent writing the April 30, 2004 memo on Antiwar.com recommended further monitoring of the website in the form of opening a "preliminary investigation …to determine if [redaction] are engaging in, or have engaged in, activities which constitute a threat to national security."

Why? Because the website was questioning U.S. war policy (for those who do not remember, if you took an anti-war position anytime between September 11, 2001 and 2004 you were considered so far Left you couldn't see straight, or you had to be a subversive, if not a traitor to your country. It is clear from the memos the agents involved were erring toward the latter in regards to Antiwar.com.

Agents noted that Antiwar.com had, or linked to, published counter-terrorism watch lists (already in the public domain). The FBI noted at least two of Raimondo's columns and wondered openly, "who are (Antiwar.com's) contributors and what are the funds utilized for?" This, after acknowledging there was no evidence of any crime being plotted or committed.

Other things noted in the documents::

— Garris had passed along a threat he received on Sept. 12, 2001 from a Antiwar.com reader obviously disgruntled with the website's coverage of 9/11. The subject line read, "YOUR SITE IS GOING DOWN," and proceeded with this missive: "Be warned assholes, ill be posting your site address to all the hack boards tonight … your site is history."

Concerned, Garris forwarded the email to the FBI field office in San Francisco. Garris heard nothing, but by January 2002, it turned up again, completely twisted around, in a secret FBI memo entitled, "A THREAT BY GARRIS TO HACK FBI WEBSITE."

It turns out this "threat" went on to justify, at least in part, the FBI's ongoing interest in monitoring the website.

Hour 2 - Starchild (libertarian activist) comes on the show to discuss open borders

From Terry Bressi (CheckPointUSA.org) ( Starchild and Ernie talked about Terry's experience, some details below from over 20 yrs. ago...):

Hi Ernie

Here's my recollection of the events from 1997. The UA began rolling out a new ID policy and ID card program (CatCard) that was "mandatory" for all UA affiliates (students, employees, professors, alumni, etc.). This new ID policy and ID card program would require the following:

* A digital photograph and digital signature stored in a networked computer environment accessible to the UA and it's business affiliates

* The use of a magnetic stripe on the ID card containing unencrypted personally identifiable information including but not limited to a physical description, social security number, driver's license info if available, date of birth, UA affiliation, etc.

* The use of a digital chip that would store everything available on the magnetic stripe along with additional information including but not limited to financial aid information, bank and credit card account information, long distance phone account information, history of transactions made through the card at the UA and through business affiliates, UA educational history, etc.

* A signed contract by each user of the ID card that would allow the UA to share information it had about the user with UA affiliates and would hold the UA harmless due to any misuse of information associated with the card user.

When the UA began rolling out this new ID policy, it scheduled a week of mass-carding events in which individuals would be required to show up in person to have their photograph and signatures recorded and sign the mandatory contract. Prior to my scheduled time frame, I did some preliminary digging into the new policy and discovered that the UA had contracted with MCI (long distance phone service company) and Saguaro Credit Union for providing phone and banking services to all card holders.

For facilitating the business relationships, the UA would receive kickbacks from MCI for each long distance phone call made by a cardholder and would receive $1.00 for each cardholder who setup banking services through Saguara Credit Union along with an annual kickback from Saguaro Credit Union that was tied to the total deposits of all individuals who opened accounts with Saguaro Credit Union through the new ID card.

Myself and a co-worker wanted to find out how far the relationship with these companies had already progressed BEFORE the new ID card had been rolled out so we called MCI to ask questions about the program and how the company would determine who would be eligible for participation. MCI assured us that they would be able to quickly verify an individual's status using their SSN because the UA had already released that information to them.

We took this information down to the mass-carding event and began asking questions of the head of the new CatCard office. She was of course completely uninterested in our concerns and told us that nobody else had complained about the program and then made some dismissive comment about how the squeaky wheel gets the grease before ignoring us all together. Since it was obvious the program would continue unabated unless one of the wheels started to squeak, I grabbed a copy of the mandatory contract & returned to my lab. I then sat down & generated an email regarding what we had discovered about the program including the UA's release of everybody's personally identifiable information (including SSN's) to for-profit companies, the kickbacks the UA was getting from these companies and verbage from the mandatory contract the UA was forcing everybody to sign that would hold the UA harmless for any misuse of a cardholders personally identifiable information.

I sent the email to several department-wide listserve's on campus that I was aware of and started receiving email and phone responses within minutes. The full blown shit-storm began shortly thereafter in which several CatCard wheels became very squeaky and the grease was nowhere to be found. The fallout for the UA lasted for months and resulted in a complete revamp of the ID program including the removal of most of the mandatory aspects of the program, elimination of the mandatory contract, a recall of the personally identifiable information that had been released (yeah right), and several other changes.

There's a lot more details as you can imagine but this is the gist of it.

Regards,
Terry
