On Tuesday, the Arizona Court of Appeals ruled authorities must obtain
a search warrant to conduct a blood test of a dui suspect unless the
suspect clearly consents to have their blood drawn.
So they must obtain a search warrant to collect blood without my consent. But if I consent and it is under the limit, I may not be charged with DUI, if it is over the limit I lose my license for 90 days. If I DO NOT consent I lose my license for one year. How can you willingly consent if you are coerced by the state to grant your consent...or are severely punished for not consenting? I imagine a few Appealate Court judges ponder this.
