Biden Prevails at Supreme Court in Border Fencing Dispute (3)

Texas built fence to try to stem illegal immigration

Justices split on whether to throw out injunction

A divided US Supreme Court said the Biden administration can remove parts of a fence along the southern border built by Texas to try to stem illegal immigration.

In an order on Monday, the justices vacated a December ruling by the US Court of Appeals for the Fifth Circuit that said the US Border Patrol could only cut down razor wire fencing along the Rio Grande in an emergency.

The high court provided no explanation for its decision, which is customary in emergency applications. Justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh said they would've denied the request to toss the lower court injunction while the litigation continues. They also offered no reason for their decision.

Everyone needs to do a lot of thinking about this. If Texas secedes, things will change for other border States, too. If the US wants to start a war with Texas over their contractual right to secede, there are other States that will side with Texas and secede as well. All Texas is waiting for is a Trump win to keep them from having to secede. This border issue plus a Trump loss will push them right over the edge. Remember, unlike in the past, Texas does a lot of US arms manufacturing, which it would automatically gobble up as its own if the US declared war on them. Forget Ukraine. People in America are waking up.
